OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible aluminum metal dust deflagration, explosion, or other fire hazards while working at or near aluminum metal dust collection equipment which were not designed to prevent or minimize employee exposure to fires, deflagrations, and explosions:    On or about 11/14/2012, employees were exposed to combustible aluminum metal dust deflagration, explosion, or other fire hazards as a result of:    b)  The dry-type dust collector for the Opti Sander R45V:    i.  exhaust air was redirected and recycled into the building.    ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION REQUIRED.

29 CFR 1910.145(f)(3):  Tags were not used as a means to prevent accidental injury or illness to employees who were exposed to hazardous or potentially hazardous conditions, equipment or operations which were out of the ordinary, unexpected or not readily apparent:    On 11/14/2012, tags were not used as a means to prevent accidental injury to employees who were potentially exposed to fire, deflagrations or explosions from:    b)  Grinding equipment contained in the WAGS-2 line, which lacked tags warning that the machinery was only for use with aluminum metal.    Note:  Abatement can be achieved by using warning language contained in National Fire Protection Association (NFPA) Standard 484 "Standard for Combustible Metals" (2009):  Sections 6.3.2.5.3 and 6.3.2.6.1.    ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION REQUIRED.

29 CFR 1910.1000(a)(2):  Employee(s) were exposed to an airborne concentration of particulates not otherwise regulated (PNOR) total dust listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentration of 15 mg/m3:    a)  On 11/14/2012, a painter employee operating in the powder coat spray booth was exposed to airborne particulates not otherwise regulated (PNOR) total dust at levels of 33.8 mg/m3 as an 8-hour time-weighted average (TWA), approximately 2.3 times the permissible exposure limit (PEL) of 15 mg/m3. 29 CFR 1910.1000(e):  Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d):    a)  On 11/14/2012, feasible administrative or engineering controls were not determined and implemented in order to reduce employees' exposures to concentrations of particulates not otherwise regulated (PNOR) total dust to limits prescribed in 1910.1000(a) Table Z-1.    Applicable administrative or engineering controls may include, but are not limited to, the following:    1)  Discontinue sweeping/cleaning of settled powder coat with compressed air.  2)  Conduct cleaning with vacuum system or wet/dry squeegee.  3)  Reposition the employee and work:        i)  Move the first painter position back from the parts entrance so he is standing closer to the capture faces of the   ventilation system.      ii)  Turn the pieces so that the painter employees are spraying towards the centerline of the booth.      iii)  Position both painter employees so they are not between the work pieces and the ventilation capture faces.    ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION REQUIRED.
