29 CFR 1915.12(a)(2): The employer did not ensure that spaces containing an oxygen deficient atmosphere were labeled Not Safe for Workers. Tank T1: On or about January 10, 2013, and times prior thereto, tank T1 had contained ballast water, and had been drained for cleaning, did not have signs posted warning employees. This exposed employees to a potential oxygen deficient atmosphere when entering the tank before testing.

29 CFR 1910.37(a)(4): Safeguard(s) designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times: Control Tower: (a) On or about January 10, 2013, and times prior thereto, the emergency light was not operational. This exposed employees to a potential trip hazard if they had to exit the room during hours of darkness in a emergency. Utility Building of the CUB: (b) On or about January 14, 2013, the inspection revealed that the emergency light was not in working order. Located at 5555 N. Channel Avenue in Portland, OR.
