29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complied with recognized and generally accepted good engineering practices (RAGAGEP). a. Toledo Refining Company LLC located in Oregon, Ohio: On or about January 30, 2013, the employer did not ensure the CO boilers for the FCC processing unit complied with RAGAGEP in that the boilers were not equipped with a positive means to prevent leakage of fuel into an idle furnace or flue gas path by supplying a double block and vent valve arrangement between the CO Boilers and the FCC Regenerator. b. Toledo Refining Company LLC located in Oregon, Ohio: On or about January 30, 2013, the employer did not ensure the flue gas duct work associated with the FCC CO boilers complied with RAGAGEP in that it was not equipped with dampers which could be opened prior to purging the CO Boilers. On January 30, 2013, there was a fire in the SCR duct work leading from the CO Boilers due to hydrocarbon vapors being present in the flue gas passageway when the forced draft fans were turned on.

29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information in paragraph (d) of this section) before further use or in a safe and timely manner when necessary means are taken to assure safe operation. a. Toledo Refining Company LLC located in Oregon, Ohio: On or about January 30, 2013, the employer did not ensure the CO boilers for the FCC processing unit were equipped with a positive means to prevent leakage of fuel into an idle furnace or flue gas path by supplying a double block and vent valve arrangement between the CO Boilers and the FCC Regenerator. b. Toledo Refining Company LLC located in Oregon, Ohio: On or about January 30, 2013, the employer did not ensure the management of change procedures for the FCC slide valve obstruction, performed on January 25, 2013, evaluated the loss of steam pressure and the consequences the loss of steam would have on the safe operation of the FCC reactor, stripper tower, and main fractionator. b. Toledo Refining Company LLC located in Oregon, Ohio: On or about January 30, 2013, the employer did not ensure the management of change procedures for the FCC slide valve obstruction, performed on January 25, 2013, evaluated the accumulation of hydrocarbon vapors in the SCR ductwork. c. Toledo Refining Company LLC located in Oregon, Ohio: On or about January 30, 2013, the employer did not ensure management of change procedures were implemented for the CO Boiler start-up after the FCC reactor had to be unexpectedly shut down due in part to a malfunctioning spent catalyst slide valve. At the time of the CO Boiler start-up the FCC spent catalyst slide valve was broken and not closing, thereby allowing hydrocarbon vapors to travel through the CO boiler inlet valve and into the SCR ductwork.
