29 CFR 1910.119(l)(1): The employer did not implement procedures to manage changes to process chemicals, technology, equipment, and procedures, and changes to facilities that affect a covered process: a) Toledo Refining Company, LLC - Oregon, Ohio: On or about November 12, 2021, the employer did not implement the management of change procedure following the identification of a section of thin piping on the north side of the E-9262 Depropanizer Reboiler in the Hydrocracker Unit, which was identified as being below minimum thickness requirements following a routine inspection. Failure to implement management of change procedures to evaluate the safe operation of equipment outside of acceptable process safety information can lead to the loss of primary containment of flammable hydrocarbons, and expose employees to fire and explosion hazards. b) Toledo Refining Company, LLC - Oregon, Ohio: On or about November 22, 2021, the employer did not implement the management of change procedure following the modification of a pipe clamp device during installation on a known section of thin piping on the north side of the E-9262 Depropanizer Reboiler in the Hydrocracker Unit. The contractor installing the device conducted field modifications that were different than the engineered design of the device, with no evaluation being conducted by refinery personnel for the modifications. Failure to evaluate the effects of modifying pipe clamp devices during installation can lead to the loss of primary containment of flammable hydrocarbons, and expose employees to fire and explosion hazards.

29 CFR 1910.119(j)(2): The employer did not establish or implement written procedures to maintain the on-going integrity of process equipment: Toledo Refining Company, LLC Oregon, Ohio: On or about November 12, 2021, the employer did not ensure that the written mechanical integrity procedure for Inspection Finding Management (TO-INP-PRO-704-0003 - Inspection Finding Management Procedure) was updated to reflect the priority ranking terminology used in the site's updated software system, although inspection employees had been trained in the updated software system. Employer should update the Inspection Finding Management procedure to refer to attachments or other documents that can be easily updated when improvements are made to the employer's software system to avoid there being inconsistencies regarding the appropriate priority rankings.
