OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that fire protection equipment was not maintained to protect against fire hazards:  Toledo Refining Company, LLC - Oregon, Ohio:  On or about February 3, 2019, the employer did not ensure fire protection equipment was maintained to protect employees in Tank Farm #2 from thermal hazards involved with an explosion/fire event.  Multiple fire hydrants and monitors, including #20, 41, 42 and 62 were out of service, which hindered the emergency response personnel from extinguishing the fire.  Among other methods, one feasible and acceptable method to correct this hazard includes, but is not limited to the following:    Ensure that fire protection system equipment is inspected and maintained for its intended use of fire-fighting.  NFPA 25 - Standard for the Inspection, Testing, and Maintenance of Water-Based Fire Protection Systems (2017), Section 4.1.5 states, "The property owner or designated representative shall correct or repair deficiencies or impairments."; and Section 7.4.1 states, "All equipment shall be maintained in proper working condition, consistent with the manufacturer's recommendations."
