29 CFR 1926.20(b)(2):   The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.    a) Overlook Dr., Rancocas Point, Mt. Laurel, NJ:   The employer did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, six workers were exposed to fall hazards while performing sheathing activities on a two story new construction townhome with no fall protection.  Observed on or about 4/2/2013.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   a) Overlook Dr., Rancocas Point, Mt. Laurel, NJ:   Six employees were conducting sheathing activities on a two story new construction townhome. The employees were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to fall hazards of greater than 20 feet, from the roof to the ground.   Observed on or about 4/2/2013.   NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

The employer had not provided training for each exposed employee  to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards  Observed on or about 4/2/2013. Laurel:  An employee was observed climbing a portable extension ladder while balancing a sheet of plywood on his head and as such was exposed to losing his balance and falling.  Observed 4/2/2013.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
