29 CFR 1926.20(b)(2):  The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.     a) 74 Virginia Dr., Berlin, NJ:   The employer did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, two workers installing roof sheathing were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to fall hazards of greater than 14 feet, from the roof to the ground.  Additionally, an aluminum extension ladder with a broken rung was used to access the roof of the structure.  Observed on or about 5/07/2013.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(16):  Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.   a) 74 Virginia Dr., Berlin, NJ:   The employer did not ensure that all ladders were free from damage.  As such, two workers installing roof sheathing were using an aluminum extension ladder with a broken rung to access the roof of the structure.  Observed on or about 5/07/2013.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   a) 74 Virginia Dr., Berlin, NJ:   Two employees installing roof sheathing were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to fall hazards of greater than 14 feet, from the roof to the ground.  Observed on or about 5/07/2013.   Five Star Quality Construction Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 699658, citation number 01, item number 01 and was affirmed as a final order on 4/22/13, with respect to a workplace located at 1815 Lombard St Philadelphia, PA 19146.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.  a) 74 Virginia Dr., Berlin, NJ:   Two employees installing roof sheathing were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to fall hazards of greater than 14 feet, from the roof to the ground.
