29 CFR 1926.20(b)(2):  The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.    a) 215 35th St., Brigantine, NJ :   The employer did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, two workers conducting framing activities were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to fall hazards of greater than 25 feet, from the roof to the ground.   Observed on or about 5/14/2013.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   a) 215 35th St., Brigantine, NJ:   Two employees conducting framing activities were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to fall hazards of 25 feet, from the roof to the ground.   Observed on or about 5/14/2013.   Five Star Quality Construction Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 699658, citation number 01, item number 01 and was affirmed as a final order on 4/22/13, with respect to a workplace located at 1815 Lombard St  Philadelphia, PA 19146.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.   a) 215 35th St., Brigantine, NJ:   Two employees conducting framing activities were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to fall hazards of 25 feet, from the roof to the ground.   The employer had not provided each employee training in the recognition and avoidance of fall hazards.  Observed on or about 5/14/2013.
