29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 06/25/13, on 2-story residential construction site at the Niagara County Fairgrounds, 4487 Lake Ave., Lockport, NY: Employees engaged in roofing work were not trained to recognize potential hazards on this type of jobsite including but not limited to falls from roofs and ladders, electrical hazards, and the need for personal protective equipment. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(13): 29 CFR 1926.501 (b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) On or about 06/25/13, on a 2-story residential building at the Niagara County Fairgrounds, 4487 Lake Ave., Lockport, NY: Three employees engaged in roofing work were exposed to a potential falls of approx. 8 to 18 ft. from the various edges of the roof to a lower roof or to the ground. The pitch of the roof varied from almost flat to approx. 6 in 12. No guardrail system, safety net system, or personal fall arrest system was being utilized. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access. a) On or about 06/25/13, on the south side of a 2-story residential building at the Niagara County Fairgrounds, 4487 Lake Ave., Lockport, NY: Three employees engaged in roofing work were exposed to a potential fall of approx. 18 ft. to the ground when an extension ladder was used to access the roof from the ground. The siderails of the ladder only extended approx. 18 inches above the roof. b) On or about 06/25/13, on the east side of a 2-story residential building at the Niagara County Fairgrounds, 4487 Lake Ave., Lockport, NY: Three employees engaged in roofing work were exposed to a potential fall of approx. 8 ft. to the ground when an extension ladder was used to access the roof from the ground. The siderails of the ladder only extended approx. 8 inches above the roof. NO ABATEMENT CERTIFICATION REQUIRED
