The scaffold was approximately 16 feet high and the employees were not wearing a personal fall arrest system. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 8/4/14 at a roof replacement project located at 42 Highland Avenue, Hamburg, New York; employees were tearing off an old roofing on a 2 story house that had a pitch of 8 in 12 and an eave height of approximately 16 feet. There was no fall protection in place. NO ABATEMENT CERTIFICATION REQUIRED D & M Home Improvement Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 914061, citation number 1, item number 2 and was affirmed as a final order on 7/31/2013, with respect to a workplace located at 4487 Lake Avenue, Lockport, New York.
