29 CFR 1926.451(b)(5)(ii): The end of a platform greater than 10 feet in length extended over its support more than 18 inches and the platform was not designed and installed so that the cantilevered portion of the platform is able to support employees without tipping, or has guardrails which block employee access to the cantilivered end: a) On or about 06/25/19, on a roofing job site, at a house at 28 Ivy Lea, Tonawanda, NY: A ladder jack scaffold consisting of 2 support ladders and an approx. 20 ft. long aluminum pik was erected on the front right side of the house. The pik extended over the bracket on the right support ladder by approx. 5 1/2 feet. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 06/25/19, on a roofing job site, at a house at 28 Ivy Lea, Tonawanda, NY: Three employees engaged in roofing work on the steep roof of the house were exposed to a fall of approx. 18 ft. because fall protection was not being utilized. Pitch of the roof was approx. 15 in 12. NO ABATEMENT CERTIFICATION REQUIRED DM Home Improvement Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1390892, citation number 1, item number 2 and was affirmed as a final order on 05/22/2019 with respect to a workplace located at 5662 Wendy Circle, Lockport, NY 14094. D & M Home Improvement Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 988880, citation number 2, item number 1 and was affirmed as a final order on 09/29/2014 with respect to a workplace located at 42 Highland Avenue, Hamburg, NY 14075.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or about 06/25/19, on a roofing job site, at a house at 28 Ivy Lea, Tonawanda, NY: Ladder Jack Scaffolding was erected on the front side of the house. An extension ladder was provided for employees to access the aluminum pik on the scaffold. The side rails of that extension ladder were only approx. 17 inches above the pik. b) On or about 06/25/19, on a roofing job site, at a house at 28 Ivy Lea, Tonawanda, NY: An extension ladder was provided for employees to access the canopy roof over the entrance to the front door. The side rails of that extension ladder were only approx. 30 inches above the roof. NO ABATEMENT DOCUMENTATION REQUIRED DM Home Improvement Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1390892, citation number 1, item number 3 and was affirmed as a final order on 05/22/2019 with respect to a workplace located at 5662 Wendy Circle, Lockport, NY 14094.
