29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a). At the Garden Park development in Fern Park, an employee being elevated in an aerial lift to the fourth floor balcony did not have a harness and lanyard to connect to the boom or basket of the aerial lift as required for fall protection as observed on or about June 27, 2013.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest: (a) At the Garden Park development in Fern Park, an employee working from the third floor balcony where no guardrails were installed was exposed to a 20-foot fall hazard as observed on or about June 27, 2013. (b) At the Garden Park development in Fern Park, an employee working from the fourth floor balcony where no guardrails were installed was exposed to a 29-foot fall hazard as observed on or about June 27, 2013. MAG Construction Group, LLC, was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in the following inspections: 1. Number 878344 Citation 01 Item 001 and was affirmed as a Final Order on March 18, 2013, with respect to the workplace located at 1651- 1653 Bragg Drive, Celebration, FL 34747.
