29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer. a) 20 Buoy Dr., Mount Laurel, NJ : The employer did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, two workers conducting framing activities were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to fall hazards of greater than 21 feet, from the second story exterior wall top plate to the ground. Observed on or about 7/30/2013. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) 20 Buoy Dr. Mount Laurel, NJ: On or about 7/30/2013, two Top Class Construction Inc. employees conducting framing activities were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to fall hazards of greater than 21 feet, from the second floor exterior wall top plate to the ground. Top Class Construction Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 903286, citation number 01, item number 01, group a, and was affirmed as a final order on 6/24/2013, with respect to a workplace located at 2000 Kimball Street, Phila, PA.
