OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards while operating the Genie Personnel Lift. a) On July 22, 2013, the employer did not maintain the Genie Personnel Lift (ML-01) in a manner which would assure that safety enhancing devices (outriggeres) were stored in the lift.
