29 CFR 1910.1025(c)(1):The employer shall assure that no employee is exposed to lead at concentrations greater than fifty micrograms per cubic meter of air (50 ug/m(3)) averaged over an 8-hour period. On or about June 14th, 2024 at Crown Battery Mfg. Co. located at 1445 Majestic Drive Fremont, Ohio 43420: Instance A) An employee performing the job task of off bearing on line #3 was exposed to a time weighted average (TWA) of 0.2741 ?g/m3 for lead, approximately 5 times the Permissible Exposure Limit (PEL) of 0.05 ?g/m3 for 8 hours shift. The exposure level was derived from a sample collected over a 424 minute sampling period, with zero exposure assumed for the unsampled period of 56 minutes. Instance B) An employee performing the job task of off bearing on line #4 was exposed to a time weighted average (TWA) of 0.0814 ?g/m3 for lead, approximately 1.5 times the Permissible Exposure Limit (PEL) of 0.05 ?g/m3 for 8 hours shift. The exposure level was derived from a sample collected over a 414 minute sampling period, with zero exposure assumed for the unsampled period of 66 minutes. Instance C) An employee performing the job task of mixing on line #3 was exposed to a time weighted average (TWA) of 0.3122 ?g/m3 for lead, approximately 6 times the Permissible Exposure Limit (PEL) of 0.05 ?g/m3 for 8 hours shift. The exposure level was derived from a sample collected over a 418 minute sampling period, with zero exposure assumed for the unsampled period of 62 minutes. Instance D) An employee performing the job task of operator on line #2 was exposed a to time weighted average (TWA) of 0.0802 ?g/m3 for lead, approximately 1.5 times the Permissible Exposure Limit (PEL) of 0.05 ?g/m3 for 8 hours shift. The exposure level was derived from a sample collected over a 409 minute sampling period, with zero exposure assumed for the unsampled period of 71 minutes.

29 CFR 1910.1025(e)(1)(i):For any employees exposed to lead above the permissible exposure limit for more than 30 days per year where engineering and work practice controls (including administrative controls) were feasible but did not reduce the employees' exposure to or below the permissible exposure limit the employer did not use engineering and/or work practice controls to reduce exposures to the lowest feasible level: On or about June 14th, 2024 at Crown Battery Mfg. Co. located at 1445 Majestic Drive Fremont, Ohio 43420 the employer failed to ensure feasible engineering controls and work practice controls (including administrative controls) were implemented to reduce the employees' exposure to or below the permissible exposure limit. Instance A) An employee performing the job task of off bearing on line #3 was exposed to time weighted average (TWA) of 0.2741 ?g/m3 for lead, approximately 5 times the Permissible Exposure Limit (PEL) of 0.05 ?g/m3 for 8 hours shift.
