29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.      a) MacArthur Blvd., Somers Point:   The employer did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, employees installing roof sheathing were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to fall hazards from 11 feet to greater than 30 feet, from the roof to the ground.   Observed on or about 8/30/2013.   Ayala Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 316194778, citation number 01, item number 01 and was affirmed as a final order on 3/15/12, with respect to a workplace located at 110 Pine Cone Ct  Sicklerville, NJ 08081.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
