29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: On or about September 5, 2013, on the double-top plates, at the job site, the employer did not ensure that employees using nail guns were protected by the use of protective eyewear. The employees actively used the nail gun on the day of this inspection while installing 2 x 4 double-top plates for assembly of ceiling joist on the dwelling. This condition exposed the employee to serious eye injuries.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b). On or about September 5, 2013, on double-top plates, at the jobsite, the employer did not ensure that each employee working and walking on wood-framing were protected from falling 9 feet by a fall protection system. Alternative fall protection system use was not attempted. Employees were installing exterior and interior double-top plates for ceiling joist assembly on a 2,872 square foot residential dwelling.
