29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.        a) Building 600 Renaissance Dr.:   The employer did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, Ayala Construction employees installing roof sheathing were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to a fall hazard of greater than 30 feet, from the roof to the ground.   Observed on or about 12/16/2013.   Ayala Construction LLC was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 936720, citation number 02, item number 01 and was affirmed as a final order on 10/25/13, with respect to a workplace located at MacArthur Blvd., Somers Point, NJ.    Ayala Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 316194778, citation number 01, item number 01 and was affirmed as a final order on 3/15/12, with respect to a workplace located at 110 Pine Cone Ct    Sicklerville, NJ.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   a) Building 600 Renaissance Dr.:   Two Ayala Construction employees installing roof sheathing were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to a fall hazard of greater than 30 feet, from the roof to the ground. 29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.   a) Building 600 Renaissance Dr.:   The employer, Ayala Construction, did not provide employees exposed to fall hazards training to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  As such, two Ayala Construction employees installing roof sheathing were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to a fall hazard of greater than 30 feet, from the roof to the ground.   Observed on or about 12/16/2013.
