OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards of a load under tension not being free for lifting:  a.)    Lyon Shipyard, Vessel Dodge Island: On or about 12/31/13, a crane was used to apply tension during the removal of a fastened load.  Upon removal of the last bolt, the load swung, struck and killed an employee.  The load was not free to be lifted as required by the crane manufacturer's operating manual under the lifting/moving loads section.

29 CFR 1915.116(i): Employees were permitted to ride the hook or the load.  a.)   Lyon Shipyard, Vessel Dodge Island:  On or about 12/31/13, an employee, who was anchored to and standing on a dredge drag head held in tension by a crane, was unbolting the head from suspended dredge arm piping.  When the last bolt was removed the load shifted striking and killing the employee who was riding the load.

29 CFR 1915.159(b)(7): Personal fall arrest systems shall be rigged such that an employee can neither free fall more than 6 feet (1.8 m) nor contact any lower level.  a.) Lyon Shipyard, Vessel Dodge Island: On or about 12/31/13, an employee working on a dredge drag head 88 inches above the next lower level was rigged such that his personal fall arrest system would not prevent contact with the next lower level.
