OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that could cause death or serious physical harm to employees in that an employee was exposed to crushing and drowning hazards while operating a 90 U.S. ton RTC Model #8090 Series II crane without restraint systems:  a)    On or about 10-06-2018 and times prior thereto, located at Lyon Shipyard, 1818 Brown Avenue Norfolk, VA 23504, an employee who operated a 90 U.S. ton RTC Model #8090 Series II crane, was not using any seat belt restraint system and was ejected from the cab, off of the pier and into the water when the crane tipped over on its side.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employee(s) and their representatives were informed of this abatement.

29 CFR 1915.117(b): Employees who did not understand the signs, notices, and operating instructions, and were not familiar with the signal code in use, were allowed to operate a crane, winch, or other power operated hoisting apparatus.    a)    On or about 10-06-2018 and times prior thereto, located at Lyon Shipyard, 1818 Brown Avenue Norfolk, VA 23504, an employee who operated a 90 U.S. ton RTC Model #8090 Series II crane, was not properly trained and exceeded boom angle limitations while outriggers were located in the upward position and while the crane was resting on rubber tire contact only. The crane tipped backwards towards the 28,800 pound counter-weights, striking a vessel pier side when it came to final resting position and the employee was ejected from the cab, off of the pier, and into the water.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employee(s) and their representatives were informed of this abatement.
