29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch:     San Pablo Lytton Casino - Maintenance Warehouse - On or about February 6, 2014 and at times prior thereto, the Dayton Industrial (bench) Grinder's, model 1Z707X, Mfg. NO: D958, abrasive wheel tongue guard was not adjusted to maintain a distance no greater than one quarter inch between the periphery of the wheel and the guard.  The abrasive wheel was measured with a distance of at least 3/8 inch between the periphery of the wheel and the top of the cutout notch of the tongue guard.  The grinder is used at least once a week by one of the four to five day shift employees to sharpen small metal tools that could result in particles or pieces of metal being ejected from the top of the grinding wheel towards the employee.
