29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  In the upholstery shop on or about March 11, 2014, and at times prior thereto, eye protection was not worn when an air powered staple gun was used to secure upholstery onto a wood chair frame with half-inch long staples. The pressure gauge on the air compressor, connected to the staple gun, showed 90 pounds per square inch.

29 CFR 1910.133(a)(3): The employer did not ensure that each affected employee who wore prescription lenses while engaged in operations that involve eye hazards wore eye protection that incorporates the prescription in its design, or wore eye protection that can be worn over the prescription lenses without disturbing the proper position of the prescription lenses or the protective lenses:  In the cabinet shop on or about March 11, 2014, the employer did not ensure that prescription eye glasses were also safety glasses. The prescription glasses were not marked with Z87 to indicated they were also safety glasses. The glasses were worn while a SKS staple gun, Senco serial number 01300928, was used to secure sections of a cabinet together with one and one-eighth inch long staples. There was 130 pounds per square inch of pressure on the gauge for the air tank gauge that supplied air to the staple gun.

Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.:    (a) In the upholstery shop on or about March 11, 2014, and at times prior thereto, there was no guard for the chuck on a Delta Shop Master Drill Press, model number DP350, serial number 015440W2033. The drill press was used to drill holes for dollies or steel supports.    (b) In the cabinet shop on or about March 11, 2014, and at times prior thereto, there was no guard for the chuck on a Delta Drill Press, model number 17-900, serial number 0023. It was used to drill saw holes in cabinets used for trash.

29 CFR 1910.213(f)(1): Feed rolls and saws were not protected by a hood or guard to prevent the hands of the operator from coming in contact with the in-running rolls at any point. The guard shall be constructed of heavy material, preferably metal, and the bottom of the guard shall come down to within three-eighths inch of the plane formed by the bottom or working surfaces of the feed rolls. This distance (three-eighths inch) may be increased to three-fourths inch, provided the lead edge of the hood is extended to be not less than 5 1/2 inches in front of the nip point between the front roll and the work:  In the cabinet shop on or about March 11, 2014, and at times prior thereto, there was no hood guard for a Powermatic 3 Wheel Feeder, model number PF-33, serial number 06070030056. The powered feeder was used with a Powermatic table saw, model number 66, serial number 00070652373. The saw was used to rip hardwoods.

The motor was located about 1.5 feet from the operator's legs.
