29 CFR 1910.134(c)(2)(ii): The employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks):  On or about March 28, 2014, in the facility, employee(s) required to perform hand dipping and coating operations were provided and used tight-fitting full-face air-purifying respirators on a voluntarily basis.  The employer did not establish and implement those elements of a written respiratory protection program, including medical evaluation and training, to ensure that the respirator itself did not present a health hazard to the user.  Gatto Industrial Platers, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 807221, citation number 2, item number 1 and was affirmed as a final order on March 26, 2013, with respect to a workplace located at 4620 West Roosevelt Road, Chicago, IL. 60644.

29 CFR 1910.1200(f)(5)(i): The employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein and the appropriate hazard warning:  On or about March 28. 2014, in the facility, employees required to perform dipping and coating operations were exposed to the hazard of contact with hazardous chemicals including acids, alkali and metals.  The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein and the appropriate hazard warning, including, but not limited to the following:  a). Chemical Storage Room: 5-gallon secondary containers of chromate, nitric acid, brightener, etc. b). Jessop Line: 5-gallon secondary containers of chromate. c). Jessop Line: Process tanks containing acids, alkali and metal. d). Hand-Line: 55-gallon drums of nickel additive and chromate.  Gatto Industrial Platers, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 807221, citation number 2, item number 2 and was affirmed as a final order on March 26, 2013, with respect to a workplace located at 4620 West Roosevelt Road, Chicago, IL. 60644.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment:  On or about March 28, 2014, in the facility, employees required to perform dipping and coating operations were exposed to the hazard of contact with hazardous chemicals such as acids, alkali and metals, necessitating the use of personal protective equipment.  The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed.
