29 CFR 1910.106(d)(2)(i): "General." Only approved containers and portable tanks shall be used. Metal containers and portable tanks meeting the requirements of and containing products authorized by chapter I, title 49 of the Code of Federal Regulations (regulations issued by the Hazardous Materials Regulations Board, Department of Transportation), shall be deemed to be acceptable. (a) On or about July 29, 2024, the employer failed to provide an approved flammable and combustible liquid containers used for flammable liquids when transferring gasoline from an approved container to an unapproved container (plastic bucket), thereby exposing employees to hazards associated with fire.

29 CFR 1910.334(a)(2)(i): Portable cord and plug connected equipment and flexible cord sets (extension cords) were not visually inspected before use on any shift for external defects (such as loose parts, deformed and missing pins, or damage to outer jacket or insulation) and for evidence of possible internal damage (such as pinched or crushed outer jacket): a) On or about July 29, 2024, in the back-room storage area, the employer failed to ensure the extension cord attached to the 120-volt electrical pump, was visually inspected prior to use. The extension cord in use was missing the ground prong, thereby exposing employees to electrical hazards.

29 CFR 1910.334(d): Occasional use of flammable or ignitable materials. Where flammable materials are present only occasionally, electric equipment capable of igniting them shall not be used, unless measures are taken to prevent hazardous conditions from developing. Such materials include, but are not limited to: flammable gases, vapors, or liquids; combustible dust; and ignitable fibers or flyings. Note: Electrical installation requirements for locations where flammable materials are present on a regular basis are contained in 1910.307. [55 FR 32016, Aug. 6, 1990; 55 FR 46054, Nov. 1, 1990] a. On or about July 29, 2024, in the back-room storage area, the employer failed to provide an approved pump to transfer low flash point flammable liquids, thereby exposing employees to hazards associated with fire.
