29 CFR 1926.1101(k)(3)(i):  Before work in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM) was begun, the employer did not identify the presence, location, and quantity of ACM and/or PACM, pursuant to paragraph (k)(1) of this section:    (a)     Olmedo Roofing, 211 E. Lake St., Fort Collins, CO 80524: On or before April 7, 2014, before work in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM) was begun, Olmedo Roofing did not identify the presence, location, and quantity of ACM and/or PACM, pursuant to paragraph (k)(1) of this section.  Employees removed cement roof shingles, paper, flashing, and wood shake shingles from a single family residential home roof.  This work began on 4/7/14.  The employer did not sample and send for analysis any of the old roof material prior to the beginning of work.  The analysis of the sample taken by the OSHA Compliance Officer on 4/7/14 found 15% chrysotile asbestos in the cement shingles.  The cement shingles were found to be an asbestos containing material.  The employer did not identify the presence, location, and quantity of all asbestos containing materials on the roof prior to the start of work on 4/7/14.  This condition exposed employees to an asbestos hazard.

Lake St., Fort Collins, CO 80524: On or before April 7, 2014, the controlling employer did not designate a competent person on construction worksites, having the qualifications and authorities for ensuring worker safety and health in that four subcontractor employees were performing Class II asbestos work without their knowledge or proper precautions. The employees removed cement roof shingles, paper, flashing, and wood shake shingles from a single family residential home roof. The analysis of the sample taken by the OSHA Compliance Officer on 4/7/14 found 15% chrysotile asbestos in the cement shingles. The cement shingles were found to be an asbestos containing material. The controlling employer did not have a competent person on site to recognize potential asbestos containing materials before the beginning of work. This condition exposed employees to an asbestos hazard.
