29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii): a- 777 Route 70 East, Building 6, Evesham NJ: An employee, improperly utlizing a full body harness with lanyard attached, was exposed to falls hazards of approximately 10 feet to the ground surface below when performing roof shingle installation and other related activities from the roof of a commercial building with a pitch of approximately 5 on 12. This employee along with the other worksite company employees had not received any fall protection training from the company. Condition observed on or about 06/19/14. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided: a- 777 Route 70 East, Building 6, Evesham NJ: An employee, improperly utilzing a full body harness with lanyard attached, was exposed to fall hazards of approximately 10 feet to the ground surface below when performing roof shingle installation and other related activities from the roof of a commercial building with a pitch of approximately 5 on 12. Condition observed on or about 06/19/14. ATF CONTRACTOR, LLC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.501(b)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 558258, CITATION 01, ITEM NUMBER 02, AND WAS AFFIRMED AS A FINAL ORDER ON 09/07/12 WITH RESPECT TO A WORKPLACE LOCATED AT LOT 4442 MOORLINCH BOULEVARD, MEDFORD NJ. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
