29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch Facilities Shop - A double wheeled Craftsman 6" bench grinder did not have the tongue guards on both the right and left sides adjusted to within 1/4" of the grinding wheel; the measured gaps were 1" and 3/4" respectively.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): a. Facilities Department - Employees are exposed to chemical and physical hazards when they use paints, thinners, cleaning products and operate machinery such as but not limited to grinders and lawn mowers which necessitate the use of personal protective equipment (PPE). The employer has not performed a hazard assessment of each and every job category with regards to the necessary personal protective equipment. The employer shall: 1. Select and have each affected employee use the types of PPE that will protect them from the hazards identified in the hazard assessment; 2. Communicate the selection decisions to each affected employee and; 3. Select PPE that properly fits each affected employee.
