29 CFR 1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed:   a.  As of February 6, 2015, in the pallet plant, the employer had not conducted an annual periodic inspection of the energy control procedure since on or about August 29, 2013.

29 CFR 1910.147(c)(8):  Energy isolation.  Lockout or tagout shall be performed only by the authorized employees who are performing the servicing or maintenance:   a.  In the pallet plant, authorized employees were locking out equipment for affected employees so affected employees could perform servicing tasks such as cleaning, blade changes, and/or equipment change overs on various machines including, but not limited to, the following:  the Pendu Junior Gang Resaw (model: 2000E; S/N: 8706-AP) and Pendu Stringer Notcher (model:  6700P; S/N:  9502-1).

29 CFR 1910.212(a)(3)(ii):  The point of operation of machines whose operation exposes an employee to injury, shall be guarded.  The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle:   a.  In the pallet plant, the cutter heads on the Pendu Stringer Notcher (model:  6700P; S/N:  9502-1) were not adequately guarded.   b.  In the pallet plant, the blades and other moving components on Pendu Junior Gang Resaw (model: 2000E; S/N: 8706-AP) were not adequately guarded in that the door/cover was not securely fastened closed or was not installed with an interlocking system.

29 CFR 1910.147(d)(4)(i):  Lockout or tagout devices shall be affixed to each energy isolating device by authorized employees:     a.   In the pallet plant, the employer did not ensure that an authorized employee affixed lockout devices to the electrical and hydraulic energy sources prior to removing the cover (guard) for cleaning inside the Pendu Junior Gang Resaw (model: 2000E; S/N: 8706-AP).  On or about January 29, 2015, an employee was hospitalized after getting their hand caught in the saw blades.     Sawmiller, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.147(d)(4)(i), which was contained in OSHA inspection number 98904, citation number 1, item number 1 and was affirmed as a final order on December 2, 2011, with respect to a workplace located at 17235 Haydenville Road, Haydenville, Ohio, 43127.
