29 CFR 1910.178(l)(1)(i) reference by 29 CFR 1296.602(d): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a.  On February 25, 2015,  at the north side exterior of the buffet structure, the employer did not ensure the operator of the JLG forklift was competent to operate a powered industrial truck safely, exposing employees in a platform being lifted by the truck to inspect the ridge cap on the pavilion roof to the hazard of falling from heights that varied about to about 14 feet to the asphalt below.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:     a.  On February 25, 2015, in back of the pavilion next to the stairs to the buffet area, insulated gloves were not worn by the electricians that installed flexible cord number 8 wires and/or a circuit breaker in an energized 208 VAC panel, exposing employees to the hazards of contacting electricity.

29 CFR 1926.416(a)(1): No employer shall permit an employee to work in such proximity to any part of an electric power circuit that the employee could contact the electric power circuit in the course of work, unless the employee is protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means:    a.  On February 25, 2015, in back of the pavilion next to the stairs to the buffet area, the employer permitted electricians without insulated gloves to install a flexible cord with number 8 wires and/or a circuit breaker in a 208 VAC panel with energized parts were not insulated or shielded, exposing employees to the hazards of contacting electricity.

29 CFR 1926.403(i)(2)(i): Except as required or permitted elsewhere in this subpart, live parts of electric equipment operating at 50 volts or more was not guarded against accidental contact by cabinets or other forms of enclosures:    a.  On February 25, 2015, in back of the pavilion next to the stairs to the buffet area, live parts of a 208 VAC electrical panel were not guarded against accidental contact as the panel box cover was partially open and the dead front had been removed from the panel.  Electricians, installing a temporary flexible cord in the panel to power an arc welder, left the panel open and were not in the area.

On February 25, 2015, in back of the pavilion next to the stairs to the buffet area, a flexible extension cord with number 8 wires was not protected against abrasion as it was routed through a knockout in the bottom of a 208 VAC electric panel and directly connected to a 220 VAC circuit breaker, exposing employees to electrical and fire hazards.

On February 25, 2015, in back of the pavilion next to the stairs to the buffet area, a flexible extension cord with number 8 wires was not equipped with an attachment plug and was not energized from a receptacle as it was routed through a knockout in the bottom of a 208 VAC electric panel and directly connected to a 220 VAC circuit breaker, exposing employees to electrical and fire hazards.

29 CFR 1926.417(b): Equipment or circuits that were deenergized were not rendered inoperative and did not have tags attached at all points where such equipment or circuits can be energized:     a. On February 25, 2015, in back of the pavilion next to the stairs to the buffet area, a 220 VAC, 60 amp circuit breaker in the off position was not tagged and was not rendered inoperative as two number 8 wires were connected to it.  The other end of the flexible cord lay in the buffet area with the outside insulation stripped back and wire nuts on the two wires connected a 220 VAC, 60 amp circuit breaker in the panel.  Electricians installed a temporary flexible cord in the panel to power an arc welder, left the panel cover open, and were not in the area, exposing employees to electrical and fire hazards.

29CFR 1926.34(c):  Means of egress was not continually maintained free of all obstructions or impediments to full instant use in the case of fire or other emergency:    In back of the pavilion on the stairway with seven risers to the buffet area, the means of egress was not maintained free of all obstructions as a flexible cord with four number 8 wires laid diagonally across the steps.  Employees were exposed to the hazard of falling down the stairs.
