29 CFR 1910.1020(e)(1)(i): When an employee or designated representative requested access to a record, the employer did not provide access within 15 working days and did not apprise the employee or designated representative the reason for the delay and earliest date when the record can be made available:  (a) Armstrong World Industries, Inc. - The employer did not provide employee medical and exposure records when a request was made by the designated representative of a former employee, on or about January 29, 2015 and continuing to present.  (b) Armstrong World Industries, Inc. - The employer did not provide complete employee exposure records when a request for that information was made by the designated representative of a former employee, on or about June 14, 2015 and continuing to present.  The former employee routinely worked overtime and was exposed to chemicals in various departments, and that exposure information was not provided.   (c) Armstrong World Industries, Inc. - The employer did not provide material safety data sheets/safety data sheets when individual requests for that information were made by the designated representative of current and former employees, on or about January 29, 2015 and continuing to present.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1020(e)(3)(i): The employer did not ensure, upon request, and without derogation of any rights under the Constitution or the Occupational Safety and Health Act of 1970 that the employer chose to exercise, the prompt access of representatives of the Assistant Secretary of Labor for Occupational Safety and Health to employee exposure and medical records and/or to analyses using exposure or medical records:  (a) Armstrong World Industries, Inc. - The employer did not provide prompt access to employee medical and exposure records requested in a subpoena dated April 17, 2015 and delivered to the Armstrong World Industries on April 20, 2015.  The employer's response letter dated May 1, 2015 stated that the information would be provided to OSHA on June 30, 2015, but the information was not delivered to the Harrisburg OSHA Office until July 28, 2015.   (b) Armstrong World Industries, Inc. - The employer did not provide all of the employee medical records as requested in the subpoena dated April 17, 2015 for one former employee, on or about July 28, 2015. There were two instances of missing information with one report pertaining to Bates Numbers 1295 - 1320, and the other report pertaining to evaluations dated May 13, 2004 and June 8, 2004.  (c) Armstrong World Industries, Inc. - The employer did not provide complete employee exposure records as requested in response to a complaint #999883 filed on July 10, 2015, on or about July 27, 2015 and continuing to present. The employee routinely worked overtime and was exposed to chemicals in various departments, and that exposure information was not provided.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
