29 CFR 1926.451(e)(4)(i): A stairrail consisting of a toprail and a midrail were not provided on each side of each scaffold stairway: In front of the DFS in a former planter area, there were no stairrails consisting of a toprail and a midrail as there was one rail on the exterior of the tubular welded frame scaffold 9 riser stairway to the first level platform and the 9 riser stairway to the second level platform. Employees were on the scaffold to take measurements for the store logo. Employees were exposed to the hazard of falling from heights that varied up to 11 feet, 8 inches to the soil below.

29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided: In front of the DFS, there was no stairway or ladder to a former planter area elevated about 25 inches. Employees that accessed the scaffold through the area were exposed to the hazard of falling from an elevation of 25 inches to the tile below.
