29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): At the above addressed jobsite, the employer operated a JLG rough terrain forklift and had not received proper training on the safe operation of this powered industrial vehicle. The powered industrial vehicle was used to place materials on the roof and allow subcontractor employees working on the roof to take materials from the forks of the powered industrial vehicle, thereby exposing subcontractor employees on the roof to struck-by and fall hazards. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): At the above addressed jobsite, subcontractor employees engaged in residential roofing operations were not using fall protection, thereby exposing employees to fall hazards of seventeen (17) feet six (6) inches. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
