OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: 1) On May 7, 2016, the employer did not ensure that employees were protected from crushing hazards when working near heavy equipment such as a wheel loader. Among other methods, one feasible and acceptable method to abate the hazard would be to implement work rules and procedures that follow guidelines specified by the wheel loader manufacturer in the operation and maintenance manual for protecting employees working near large machines with limited visibility. These steps include: -safety instructions -controlled patterns of machine movement -workers that direct traffic to move when safe -restricted areas -operator training -a system of communication -communication between workers and operators prior to approaching the machine Examples of work rules and procedures include: -establishing controlled areas where heavy equipment travels and restricting employees from walking in or near these areas -implementing designated and marked crossing areas in locations where work requires that employees cross the travel path of heavy equipment -implementing a positive system of communication using radios or hand signals between operators and employees on foot. -using spotters in work areas to direct machinery and employees on foot.
