29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) AGL Construction Company at 1571 Grove St. Denver, CO 80204: On or before 10/3/19 the employer did not protect employees from injury in that an employee working in a trench was not wearing a hard hat as he was hand shoveling at the bottom of the trench. This condition exposed the employee to head injuries associated with falling objects.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart: (a) AGL Construction Company at 1571 Grove St. Denver, CO 80204: On or before 10/3/19 the employer did not ensure that each employee working inside a trench that was approximately 7 feet wide, 7 feet deep, and 20 feet in length was protected from cave-in, in that the trench was sloped at an angle greater than the 45 degree maximum allowable slope for type B soil. This condition exposed employees to a crushing hazard by trench wall cave-in.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) AGL Construction Company at 1571 Grove St. Denver, CO 80204: On or before 10/3/19 the employer did not protect employees from injury in that an inspection of the excavation, adjacent area, and sloping was not conducted by the competent person and corrective actions were not taken prior to employees entering the excavation. The 7 foot deep, seven foot wide trench, with walls sloped in excess of 45 degrees was not protected from cave in hazards while employees worked inside the trench. This condition exposed employees to cave in hazards. AGL Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(1), which was contained in OSHA inspection number 1391000, citation number 1, item number 1, and was affirmed as a final order on 5/10/19, with respect to a workplace located at 1506 W. Colfax Ave. Denver, CO 80204.
