29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: (a) AGL Construction Company at 2337 S Blackhawk Street, Aurora, CO 80014: On or before April 16, 2018, the exposing employer did not ensure that a daily inspection of a trench, that was approximately 8 feet deep, 3.5 feet wide at the bottom, 17 feet wide at the opening, and 20 feet long, and the adjacent area were made by a competent person for evidence of a situation that could have resulted in a hazardous condition. Three employees were working inside a trench that had unsupported vertical sidewalls which were approximately 3 feet in height from the bottom of the trench. The classification of soil was type B. This condition exposed employees to a crushing hazard by trench wall cave-in. (b) AGL Construction Company at 2337 S Blackhawk Street, Aurora, CO 80014: On or before April 16, 2018, the exposing employer did not ensure that a daily inspection of a trench, that was approximately 8 feet deep, 3.5 feet wide at the bottom, 17 feet wide at the opening, and 20 feet long, and the adjacent area were made by a competent person for evidence of a situation that could have resulted in a hazardous condition. Three employees were working inside a trench in which one side of the trench was sloped at an angle greater than 45 degrees. The classification of soil was type B. This condition exposed employees to a crushing hazard by trench wall cave-in. Abatement Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
