29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a. On October 21, 2016, employees accessed the upper level by using a job made wooden ladder that did not extend at least 3 feet above the upper landing exposing employees to a fall hazard.

29 CFR 1926.1053(b)(16): Portable ladder(s) with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.     a. On October 21, 2016, employees were using a job-made wooden ladder without cleats and the nails securing the rungs were not fully driven into the wood leaving the nails sticking out of the rungs and exposing the employees to trip and fall hazards.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a. On October 21, 2016, excavated soil materials (spoil pile), tree limbs and roots were not removed from the edge of the excavation exposing employees to slipping and falling into the trench.
