29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a. On or about April 13, 2017, at the Arbor Crossing new construction apartment building site, an employee using a pneumatic type nailer to install sheathing materials was not using eye protection and was exposed to eye injuries caused by airborne debris generated by the nailing process.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on April 13, 2017 when employees are working on installing roof sheathing panels while on the third story, 6:12 pitch steep roof of a new construction, multi-family, apartment building at the Arbor Crossing at Buck Lake apartment complex in Tallahassee, Florida without fall protection and were exposed to fall hazards in excess of 24-foot to the ground below. Garcia Building Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1005607, citation number 1, item number 1 and was affirmed as a final order on January 20, 2015, with respect to a workplace located at 10247 Hwy 92, Woodstock, GA 30188.
