29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Third Story Deck of Building at 804 E. 15th Street in Panama City, Florida: On or about August 30, 2022 and at times prior thereto, the employer allowed his employees to perform framing activities without fall protection, exposing his employees to a fall hazard of up to 22 feet 7 inches to the ground below. Garcia Building Company, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.501(b)(10), which was contained in OSHA inspection number 1578470, Citation 1, Item 1a and was affirmed as a final order on May 27, 2022, with respect to a workplace located at Hwy 59 Pedro's Tacos & Tequila Bar in Robertsdale, Alabama.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) Third Story Deck of Building at Third Story Deck of Building at 804 E. 15th Street in Panama City, Florida: On or about August 30, 2022 and at times prior thereto, the employer allowed his employees to perform framing activities without first ensuring his employees were trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection, exposing his employees to fall hazards of up to 22 feet 7 inches to the ground below. Garcia Building Company, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.503(a)(1), which was contained in OSHA inspection number 1578470, Citation 1, Item 1b and was affirmed as a final order on May 27, 2022, with respect to a workplace located at Hwy 59 Pedro's Tacos & Tequila Bar in Robertsdale, Alabama.
