29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) The employer fails to ensure effective protection against falls as required by the standard, as demonstrated on June 13, 2017: when two employees on a 3:12 pitch roof were installing roof sheathing and cutting plywood were not protected by guardrail system, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure. Employees were exposed to a 43-feet fall hazard.   b) The employer fails to ensure effective protection against falls as required by the standard, as demonstrated on June 13, 2017: when four employees  installing wood frame elements on roof trusses were not protected by guardrail system, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure. Employees were exposed to a 12-feet fall hazard.   c) The employer fails to ensure effective protection against falls as required by the standard, as demonstrated on June 14, 2017: when two employees on a 3:12 pitch roof were observed installing roof sheathing were not protected by guardrail system, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure. Employees were exposed to a 43-feet fall hazard.   d) The employer fails to ensure effective protection against falls as required by the standard, as demonstrated on June 14, 2017: when two employees were observed installing wood frame elements on roof trusses were not protected by guardrail system, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure. Employees were exposed to a 12-feet fall hazard.   Cuenca Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(2(ii), which was contained in OSHA inspection number 1193328, citation number 1, item number 1 and was affirmed as a final order on February 6, 2017, with respect to a workplace located at 14670 Continental Gateway Orlando, FL 32821.  Cuenca Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1201447, citation number 1, item number 2 and was affirmed as a final order on March 24, 2017, with respect to a workplace located at 111 Burnett Court Saint Johns, FL 32259.  Cuenca Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1215972, citation number 1, item number 1 and was affirmed as a final order on July 12, 2017, with respect to a workplace located at 935 Oviedo Blvd. Oviedo, FL 32765.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a) On or about June 13-14, 2017: Employees were installing wood framing elements on roof trusses and roof sheathing on a residential structure and were exposed to a fall hazards of 12 to 43-feet and the fall protection training certification was not provided.    Cuenca Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(b)(1), which was contained in OSHA inspection number 1215972, citation number 2, item number 1 and was affirmed as a final order on July 12, 2017, with respect to a workplace located at 935 Oviedo Blvd. Orlando, FL 32765.
