29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) At Building 7 on or about August 14, 2017, an employee was holding by hand wooden trusses upright for installation when they became unstable and fell forward which caused him to be thrown from the side of the building approximately 30 feet below to the ground. The employee was not trained on hand erection procedures of trusses.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. At Building 7 on or about August 15, 2017, an employee not using fall protection was using their hands to hold wooden trusses upright for installation, became unstable and fell approximately 30 feet from the side of the building to the ground below. The Cuenca Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1215972, citation number 01, item number 001 and was affirmed as a final order on 07/12/2017, with respect to a workplace located at 935 Oviedo Blvd. Oviedo, FL 32765. The Cuenca Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1201447, citation number 01, item number 002 and was affirmed as a final order on 03/24/2017, with respect to a workplace located at 111 Burnett Court Saint Johns, FL 32259 The Cuenca Construction Corp was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.501(b)(2)(ii), which was contained in OSHA inspection number 1193328, citation number 01, item number 01, and was affirmed as a final order on 02/06/2017, with respect to a workplace located at 14670 Continental Gateway Orlando, FL 32821.
