29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck was dismounted and within 25 feet of the truck still in his view, the load engaging means were not fully lowered, controls neutralized, and the brakes set to prevent movement. (Construction Reference 1926.59) On or about August 2, 2017 at 129 Bellehaven Drive, Woodstock, Georgia, an all terrain forklift was used to lift sheets of plywood to the second floor and passed through a window. The operator left the controls to unload the plywood.

None of the employees were wearing or using the fall protection they had.
