29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    On or about September 12, 2017, Isle Royale National Park had not implemented the elements of a hearing conservation program for employees exposed to occupational noise of 85 dBA or greater. An employee operating the Angelique (LCM) was exposed to occupational noise at an eight-hour time weighted average of 89.0 dBA.     The National Park Service was previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR 1910.95(d)(1), which was contained in OSHA inspection number 1221697, Notice number 1, item number 1 and was affirmed as a final order on June 7, 2017, with respect to a workplace located at 3501 Old Nashville Hwy, Murfreesboro, TN.     A comprehensive, effective hearing conservation program consisting of the following elements shall be developed and implemented for all employees whose exposure equals or exceeds 85 dBA on an 8-hour time-weighted average:    1. Development and implementation of a monitoring program to identify employees for inclusion in the hearing conservation program and proper selection of hearing protectors.    2. Establishment and maintenance of an audiometric testing program including baseline audiograms and annual audiograms thereafter.    3. Institution of an initial training program for employees, as well as annual refresher training, including information on the hazards of noise, the purpose and proper use of hearing protection, and the purpose of audiometric testing.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:      On or about September 12, 2017, the employer did not provide training on hazardous chemicals used by employees such as, but not limited to, sodium metasilicate, sodium hydroxide, ethylene glycol, and diesel fuel, which are included in Super Clean cleaner- degreaser, Peak coolant/ antifreeze, and diesel fuel when serving park boats and working in the Power House. Employees were exposed to inhalation and skin contact hazards that could result in health effects such as, but not limited to irritation or burns of the respiratory tract, skin and eyes, and cancer.    The National Park Service was previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR 1910.91200(h)(3), which was contained in OSHA inspection number 1239546, Notice number 1, item number 2 and was affirmed as a final order on July 24, 2017, with respect to a workplace located at Armistad Access Road, Fairbanks. AK.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:  a) On or about September 11, 2017, in the maintenance area in the administration building, the employer did not ensure that containers storing hazardous chemicals such as, but not limited to motor oil were labeled or marked with the appropriate hazard warnings in that a 16 oz. bottle containing oil was labeled as drinking water and was not marked with a product identifier or information regarding the physical and health hazards of the chemicals.  b) On or about September 11, 2017, in the boat shop, the employer did not ensure that containers storing hazardous chemicals such as, but not limited to triethanolamine which is contained in Simple Green degreaser were labeled or marked with the appropriate product identifier and hazard warnings in that a quart sized spray bottle did not have any labeling or markings on it.   The National Park service was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(f)(6), which was contained in OSHA inspection number 1085942, Notice number 1, item number 3, and was affirmed as a final order on October 23, 2015, with respect to a workplace located at 1 Black Canyon Rd. in San Bernardino, CA.
