29 CFR 1910.119(j)(6)(iii): The employer did not assure that maintenance materials, spare parts and equipment are suitable for the process application for which they were used: a) Toledo Refining Company, LLC - Oregon, Ohio: On or about April 11, 2018, the employer did not ensure that replacement components for the burner assembly in the H-9502 were suitable for the original design of the burner. The rebuild of the heater/burner following the March 1, 2018 incident included components from a different revision of the design of the equipment. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices: a) Toledo Refining Company, LLC Oregon, Ohio: On or about April 11, 2018, the employer did not document that it had in place quality assurance steps, consistent with API Recommended Practice 535, Burners for Fire Heaters in General Refinery Services, sufficient to ensure that certain third-party supplied replacement components for a heater burner assembly were consistent with the then-current burner design.
