29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a. Employees performing framing work on the second level of the townhouses six feet or more above the ground are not protected from fall hazards by a fall protection system.   The employer fails to assure effective protection against falls as required by the standard, as demonstrated on May 17, 2018 when employees are working on installing the 2nd floor outer framed walls from the 2nd floor deck, of a new construction, multi-family, townhomes building D at the Junction at West Hill in Pensacola, Florida without any fall protection systems and were exposed to fall hazards in excess of 11-foot 7-inch to the ground below.   Garcia Building Company, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1226360, citation number 02, item number 001 and was affirmed as a final order on June 27, 2017, with respect to a workplace located at 3810 Buck Lake Road, Tallahassee, FL 32317.  Garcia Building Company, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1205394, citation number 02, item number 001 and was affirmed as a final order on May 15, 2017, with respect to a workplace located at 3788 Buck Lake Road, Tallahassee, FL 32317.  Garcia Building Company, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1005607, citation number 01, item number 001 and was affirmed as a final order on January 20, 2015, with respect to a workplace located at 10247 Hwy 92, Woodstock, GA 30188.
