29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  At the location of 9819 Brockway in Lenexa, KS, employees working below workers operating pneumatic nail guns to frame a residential house were exposed to head injuries. The employees were exposed in that head protection was not in use to protect the employees from an impact to their head.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system or personal fall arrest systems:  At the location of 9819 Brockway in Lenexa, KS, an employee working on a second level approximately 13 feet to the ground below, operating a pneumatic nail gun was exposed to fall hazards. The employee was exposed in that a fall protection system was not in place to keep him from falling.

29 CFR 1926.503(a)(1): The employer did not train each employee who might be exposed to fall hazards to enable them to recognize fall hazards and the procedures to be followed in order to minimize these hazards:  At the location of 9819 Brockway in Lenexa, KS, an employee working on a second level approximately 13 feet to the ground below, operating a pneumatic nail guns was exposed to fall hazards. The employees was exposed in that training was not provided to minimize the hazards of falling from the second level to the ground below.
