29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. At a worksite located at 3525 SE Corbin Drive, Lee's Summit, MO an employee was exposed to eye injury hazards. The employer exposed the employee to these hazards by allowing them to utilize a pneumatic nail gun without using eye protection. Ovalle Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1601130, citation number 1, item number 1 and was affirmed as a final order on 11-1-2022, with respect to a workplace located at 17733 Slater St. Overland Park, Kansas.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): At a worksite located at 3525 SE Corbin Rd, Lee's summit MO, employees were exposed to fall injury hazards. The employer exposed the employees to these hazards by allowing them to work at heights greater than 6 feet without the use of fall protection. Ovalle Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1601131, citation number 2, item number 1 and was affirmed as a final order on 11-1-2022, with respect to a workplace located at 17733 Slater St. Overland Park, KS.
