29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. a. On or about July 11, 2018 employees had used an aluminum articulating ladder to gain access to the roof they were working, and the side rails were not long enough to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on June 29, 2018, when employees are working on a residential roof at 156 Gala Circle, Daytona Beach, FL 32127 without fall protection and are exposed to falls of approximately 9 feet to the ground below. Derek Williams dba Rogero & Williams Roofing Contractors, Inc. previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR1926.501(b)(13) which was contained in OSHA inspection number 1137948, citation number 2, item number 1 and was affirmed as a final order on September 14, 2016, with respect to a workplace located at 5185 Datil Pepper Road, Saint Augustine, FL 32086.
