Employee was exposed to falls of 18' 9" from the 40' portable aluminum extension ladder used to access upper levels given that the ladder's side rails did not extend at least 3 feet above the roof being accessed. Violation observed on or about 07/05/2018.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. Instance a) Nast Road, Building #48, Morristown, NJ. Employee was exposed to falls from the 40' portable aluminum extension ladder used to access upper levels given that the ladder was not withdrawn from service or marked as defective as rails were bent, a rung was bent and a rung and ladder feet were missing. Violation observed on or about 07/05/2018. Navy Contractors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(16), which was contained in OSHA inspection number 1300288, citation number 1, item number 3, and was affirmed as a final order on June 6, 2018, with respect to a workplace located at 62 & 64 Wadsworth Avenue, Lakewood, NJ.
