29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a. On or about October 16, 2018, at the above addressed jobsite, employees performing residential carpenter operations from a Genie GTH-644 rough terrain fork truck , fifteen (15) feet three (3) inches above the ground, were exposed to injuries from falls due to the lack of fall protection.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.    a.  On or about October 16, 2018, at the above addressed jobsite, employees had been provided fall protection training, however, the employer failed to keep a written certification of record.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a.  On or about October 16, 2018, at the above addressed jobsite, employees performing sheething operations on a  roof eleven (11) feet two (2) inches above the ground were not protected from falls, thereby exposing employees to fall hazards.    b. On or about October 16, 2018, at the above addressed jobsite, an employee performing residential construction operations next to window openings on the second floor, twenty (20) feet above the ground, was not protected from falling, thereby exposing the employee to fall hazards.     TBR Construction, LLC,  was previously cited for a violation of an equivalent Occupational Safety and Health Standard 1926.501(b)(11), which was contained in OSHA inspection number 1208307, citation number 1, item number 4 and was affirmed as a final order on March 28, 2017, with respect to a workplace located at 1825 S. Macarthur Blvd., Springfield, IL.
