29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    (a)  In the Rig Beams Area, on or about December 20, 2018, a monitoring program was not implemented for the employee who was exposed to noise at 169% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 88.7 dBA during the 347 minute sampling period, resulting in a noise hazard.    (b)  In the Decking Area, on or about December 20, 2018, a monitoring program was not implemented for the employee who was exposed to noise at 139% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 87.3 dBA during the 353 minute sampling period, resulting in a noise hazard.
